I wanted to warn everyone that I ordered 6 copies of Inked Magazine and paid for them using PayPal. This was over a month ago. I have yet to receive anything from them. This was an issue for which I wrote the cover story free of charge. It is the interview with Thomas Barbey. The people at the magazine are so classless that they sent me not a single copy of the issue.

I complained to PayPal and the complaint was simply dismissed by them. I have yet to find a reason for their dismissal.

Be aware that if you send money to Inked to may find as I have that you are simply donating money to them. Also be aware the PayPal has no real mechanism through which to assure that anything is delivered to you.

That's why I always use a credit card whenever possible with PayPal. If PayPal won't refund my money the credit card company gives me 90 days to file a complaint.

Yep, I never keep money in my Pay Pal account, everything is paid with the CC.

I'd rather deal with issues like this in private, however; this warrants a public response. Thom, I have over a dozen e-mails stored on my computer asking for your mailing address because the one I had wasn't correct. Back in July, I sent you 10 copies of the July/August issue (4 more than you had asked for) via USPS Priority Mail. It got returned to me. I e-mailed you SEVERAL times to try and find out a different address, but you never got back to me.

I have a Golden, CO address for you that you sent me directly on July 5 and that is the exact address I tried to send it to you.

Now, for my first and second issues, I had people who didn't get magazines who politely either gave me a call or e-mailed me and wanted to find out what was happening with the magazine order (since I am running this as mostly a one-man crew it is possible for me to overlook an order, I am not perfect, yet). It's almost two months, I've left a dozen e-mails to you and spent money shipping magazines to you and I finally hear back from you NOW? Thom, this isn't the way people go about things...

However, this is the way you've dealt with it. So, you have two options: A: I can refund your money before 9/5 (PayPal allows me to refund money up to 60 days) or B: I can send you out another 10 copies of the magazine at an address you supply me different than the other one, plus a copy of my third issue which just came off of the presses last week.

It's a good thing to have a community like this where we can talk to each other.

It is common for writers and illustrators to have to work extra hard collecting their contracted fee from publishers.

Next time you look at the pretty magazines on the rack at the bookseller, ponder which ones actually paid for their content. Many do. Some never do.

In defense of Inked/Focus magazine, I have corresponded with the publisher and he has provided everything that I have asked for (ie, tracking numbers, receipt of address info, etc). I have used the tracking number provided by DavidS and UPS has my package arriving today. Communication is key, people.

I really enjoyed your article,

I have recieved all issues I have subscribed to (I have 2 subscriptions) ... Dave seemed to have had a bit of a problem getting it "off the ground" but seems to be up and running now...the upcoming issue I feel is the best yet. I am confident all will be resolved and sometimes an open forum can help. David S. has always responded in a timely manner to my e mails...he has also been open to suggestion as to scope and content. This Oct issue will bear the new title FOCUS....I do wish success on this publication and all upcoming publications promoting photographic arts...

For the record. I have recieved a total of zero emails from David.
The Golden, Colorado address he has is correct (I have lived at that address for more than 3 years) and there has, to the best of my knowledge, never been any attempt to deliver any magazines to me.
Since you have offered to fullfill the order I paid for I would appreciate receiving the issues.

Perhaps you guys need to talk on the telephone to clear this up, instead of "he said", "he said" type of conversations.

Good idea Robert, at the very least would make sure to confirm address info...make sure the address that material was sent to is indeed correct...sent something one time and would have sworn the address was correct, it wasn't but was lucky the post office called me at home and ask me where it was I wanted to send it....Good service from the USPS...it does happen.

David tried to make this sound like some kind of little spat. The fact is, I paid $37.50 for copies of Inked magazine, he DID have the correct address. The magazines were never sent. He said he would send them. Confirmed the address again. I still have seen no magazines and no money. If you paid for something and didn't get it would you consider a little "he said, he said" situation? I don't think most of you would.

Have you tried calling him on the telephone? Frankly, it does sound like a "he said, he said" situation to those reading this thread. It might be worthwhile to just forget about the $37.50.

Oh damn I ordered some film from BH and they never sent it. Guess I'll just have to write off the money and order it again or go with out.

When someone pays for something it should be delivered. If it is not then they should be nagged and nagged. I agree that this should be handled over the phone but maybe that would not get a response from the mag either. Bad press is a powerful tactic. If you are scum and steal money(which is what happens when someone pays you for an item and you never produce the item) then you deserve to be called a thief. Plain and simple.

Whatever the situation here is I am sure that a combination of phone calls and bad press will get thom the mags he ordered

I agree, but this nagging can be done in private. If you still can't receive the magazines then contact the federal authorities about possible postal fraud allegations. What I am tired of is hearing about it here on Apug; regardless of whether you want it to or not, it still sounds like "he said, he said."

but a quick posting to say that you called David and the results of the phone call or that the magazines arrived. Any new information would be a boon, but continual harping, to me, just seems pointless and annoying. It has had one effect, though, I passed on subscribing to the magazine.

As I just got done telling another photographer on here, I had a family emeregency last week that caused me to pretty much put the magazine on the backburner most of last week. I have unfortunately more business to take care of with this horrible matter...but it will not delay me sending out magazines tomrorow.

I am currently looking for some help right now as nothing comes before family in my life, yet I still have a magazine to run. If some photographers are interested in helping me, please private message me.

Even with everything that I am going through right now, I came back to my home office to ship out 6 copies of my second issue plus a copy of my 3rd issue to Thom.

Also, as I have not updated it on the website, yet, the first, second and now third issues are out of print. I printed over 1,000 extra of both issues simply for back orders. I am now completely out of them. Starting in the next few days, I will be taking pre-orders for our 208 page Collector's Edition, due out in early Nov.

Can you please update us on the situation? I was thinking about subscribing, but if no one receives magazines they pay for, then I won't.

I have received my issues,

I have not received the latest, I understand it should be delivered locally in about 3 to 4 weeks, I will update and review when it arrives.....I suppose there are a lot of frustrations, and "bugs" to work out in publishing and distributing a specialty magazine as some of us are painfully aware....I remain enthusiastic that Dave will see this through and we will have a good periodical promoting what we love best...

I did see a really good preview of the 3rd issue of magazine now titled Focus, and stated in an earlier post/thread that I was really impressed with it, I am looking forward to receiving a hard copy....it has a lot of good reference material in it and you will recognize quite a few Apuger's work and advertisements in this issue....

I do subscribe and or purchase View Camera, LensWork, Camera Arts, Art in America, and others, including the forthcoming Emulsion.....

I also, in an earlier post, voiced my concerns about receiving my issues late....that was corrected....in retrospect, while this forum is a heads up to members, I got good response when I e mailed Dave Spivak directly and he took care of my concerns....

In answer to PhotoManiac's concerns, it it a bold and new venture, publishing a fine art mag, there quite possibly will be more bumps and quirks to work out...don't know til you venture out, it is a big venture, certainly way beyond my abilities, mental and financial, and I applaude Steve Simmons, and Brooks Jensen, and Sandra Brandt, and David Spivik and Aggie for doing just that,

I get many hours of enjoyment and information reading about what I really love, (even the back issues and the late ones)..I get excited when a new voice comes on the scene....

Personally, bottom line...

to me, the publication merits my support and Focus magazine is worth the money.

Is Focus sold in stores? I've never seen it on a newsstand anywhere. I might be interested in subscribing, but I have to see one first.

Yes... I saw the second issue at Borders. I haven't seen the third issue on the newsstaands yet but I think it just went out to the subscribers last week.
