I came across this on ebay today...
A Kouklis original
and it made me wonder how many others here on have had their work sold in a tertiary manner such as this? also what peoples thoughts were on it (both those that have experienced this and the rest of us)

Also, kerik, you should ask for a portion of the selling price :smile:

It's not only a treat to see this excellent photograph, but also to see how nicely it has been matted for presentation. I doubt there's any possibility for Kerik to collect a dime from this resale unless there were a licensing provision wherein the original "buyer" didn't actually own the photograph, but only the right to keep it in perpetuity. The whole notion of licensing intellectual property that has a concrete form seems to be recent, and I'd be very surprised if very many visual artists have explored the implications and ramifications of such a contract.

Is this a re-listed item...seems like I recall seeing one of Kerik's wonderfull prints before the holidays there as well?

Thought it was pretty cool then, too.

The idea of an artist receiving some compensation from the reselling of work at auction gets discussed from time to time. Of course galleries and auction houses would be opposed big time.

I may be wrong but I think the EU has discussed the idea to apply to works resold there. IIRC the notion may have been discussed on APUG a year or two back.
 
From what I know if the illustration/painting market when an artist starts to have a lively secondary market for the work then the originals start going for a lot more. Some artists price low early in thier careers to try and stimulate the secondary reselling.

I've never heard of compensating the original artist in this situation. It's kind of like Ford expecting a cut when I sell my used Mustang.
