Depends on how famous the face is... and how much control the heirs retain. If you are selling prints of your own copyrighted work for hanging on the wall, I would say you are probably within your rights. Licensing the image for commercial use is another matter.

Martin Luther King jr. and Jimi Hendrix come to mind instantly as both families are very protective of both writings and images.

I agree. My sales would be for art prints, not the image. I would require any purchaser to agree to that.. but does anyone out there have direct knowledge of this kind of transaction? Has this been tested by a court? Anyone been challenged? I'm attempting to determine the parameters before I put my gallery on line. I have never-before-seen images of Bill Evans, Miles Davis, Cannonball Adderley, Stan Getz, Chick Corea, Keith Jarrett, Herbie Hancock, Oscar Peterson and many others. I know there's going to be some controversy over ownership as soon as I go public.
