By the way, I am sympathetic with NB. That’s why I said I went through the same thing. I’m not sure why that didn’t come across. It sucks. But it happens.

OP, I agree with you that the would-be seller acted badly but don't see how you can call them crooks. When your adventure with them began they had an item and you had some money. When the adventure ended they had the item and you had the money. Where's the crime?
Let's see, deliberately misrepresenting an item is fraud, a punishable crime.

I had this happen recently with a buy it now purchase on eBay. After I bought the item the seller canceled the transaction and refunded my money. What pissed me off is the reason he gave to eBay for the cancellation. He said I requested it be canceled, complete lie. I confronted the seller on it and he said the listing was a mistake. If I make a mistake like that on eBay I honor the sale, it’s my own fault.

No, inducing someone to suffer damage or loss as a result of deliberate misrepresentation is a crime.

Here's a reasonable definition of fraud:
A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.

Cancelling a sale without collecting the money is a dick move, but not an actual crime. Fraud would be taking the money, and sending him a broken Lubitel instead of a working Rolleiflex. Or taking his money and not sending anything. Or suggesting that he might have won a massive settlement as part of a class-action lawsuit, and all he has to do to collect his money is put up 10% of his (future) winnings.

Disclaimer: Before I'm accused of being a criminal and fraudulently misrepresenting myself as a legal expert (which I'm not), I merely know how to read, and was taught the basics of law a long time ago.

Yes, eBay is very hit-or-miss. I recently tried to purchase a rare lens hood for an unusual lens I own (deliberately leaving out the details as they’re fairly identifiable and I promised the seller not to post further negative feedback). Anyway I paid my money and the item shipped. And vanished... gave it a month and finally emailed the seller to ask if he could help and got “nope, sorry, no refund either.” So I left negative feedback. This did get me a refund but not after a few angry messages back and forth. And now it’s been nearly two months, the lens hood is nowhere to be found. I’m sticking to major dealers for now.

It's all about perspective. I've had B&H misplace an order for a week, I've ordered items from China and had them 5 days later. Right now, I'm expecting within the next day or two, a set of "old new stock" film holders from Japan-- that I ordered April 9th. Japan Post has had them since April 14th, and only managed to get them into this country this week. That's not because of eBay, or the seller, and I would be a jerk to slam the seller for something out of their control.

Similarly, a friend recently had a guitar shipped to him-- it got to the nearest depot, disappeared for two weeks, and after a track/trace was started, it showed up in Kansas, and was then delivered to him a few days later (the label fell off, so it was shipped to UPS "Lost and Found").

I purchased a used lens from Adorama about a year ago, a very good deal for the lens. Right when it was set to ship, my order got cancelled, and the lens reappeared on the site the next day for $100 more. I think that someone probably realized that I was getting too good of a deal and stopped the order! By the way, I don't think the shenanigans rose to criminal, or even very annoying. It was probably a pricing mistake. I still buy from Adorama. But nevertheless, that exact thing the OP of this thread describes happened to me with one of the "reputable" dealers.

I bought a lens a year ago that had a serious problem. I tried to get a refund but Ebay sided with the seller.
Used to be a seller on eBay and I've never, ever heard of eBay siding with the seller. All the buyer has to do is check the "item not as described" and send it back. Refund includes all shipping costs.

I had a problem with Garys camera in Indiana several years ago and contacted ebay because they were listing a broken item as works. they are a brick / mortar store so I called them and asked about the old wollensak portrait lens before I bid on it to make sure the studio shutter wasn't toast. well, it was toast and didn't work. I asked if the guy if they were going to revise their auction page and he called me a nazi and hitler... I contacted they did absolutely nothing, and the seller decided to not change the description but he cancelled the opening bid from 300$ to 1200$. not sure how well that reporting system works on eBay...

When you get into an argument and you call the other person Hitler, you automatically lose the argument. :D

I have seen sellers that had 94% rating, magically jump to 100% in a couple of months. I think they can request negative reviews to be taken off. As for the reporting, I once saw a few listing of fishing reels being advertised as a different reel. They were advertised as $400 dollar reels by a famous company, but it is actually one of their $120 dollar reels with stickers to match the $400 one. If it was someone new or not aware of stuff like that they would have bought it as it was pretty cheaply listed. I reported it, it got removed in a couple of days. A few weeks later it is back again.

Negative feedback cannot be removed.

However, after a period of one year with no negative feedback the feedback will reset to 100%

Some dodgy dealers take full advantage of this.

They both also sell on ebay, and when they do those items are not listed for sale on their own websites.

That's interesting. Most brick-and-mortar stores I've seen selling on eBay also list the items on their own web site, and they are less expensive on their own web site since they aren't subject to eBay fees. When I see something I want on eBay being sold by a B&M store I always check their own web site in order to save some $$$. I usually pay with PayPal (if possible) so I get the same buyer protection.

yea .. good old Godwin.. the guy was dishonest and harsh. I feel badly for anyone who bought that lens and had to deal with them after the sale when they realized the lens had separated & had fungus ( they realized the glass was a mess when I called and asked them about the shutter ) and that the shutter was suck OPEN so they buyer wouldn't even be able to close it ( except by removing the glass and sticking fingers inside the lens and pulling the aperture closed ). not quite as "minty fresh" as described. im glad I called and was called names and didn't buy the lens, tbh. I've only had only a handful of bad internet buying / selling experiences and one-less is fine by me...

I am still HIGHLY insulted by this. HIGHLY.

I was staying at a hotel in the Caribbean some years ago, standing behind a famous lawyer at the desk when we found out our flights were cancelled. "This is an outrage!" I shouted. The lawyer turned to me and said, "Yes, but it's a small outrage."

This seller has just received 8 negative feedback on the auction site in the past month with sales totaling $14k

Absolutely shocking - all Hasselblad related camera sales. Mostly items not received followed by no communication, and no refund.

That's pretty serious stuff. They have been reported and hopefully they will be receiving a visit from the authorities soon.

The auction site has been very slow to help and still no refund almost 6 weeks in. Case is now with the pay provider.

I dont know why auction sites remove negative feedback after 1 year. They dont remove positive feedback after a year. This leaves buyers vulnerable to sellers who can operate multiple store fronts.
