I always find it a point of discussion if companies are selling expired film as 'new' films
To find a good answer to the OP's question we should ask first : " Who is able today to manufacture new E6 films.?"
Ektachromes ETA is in the very near,
Ferrania makes a stopover in bw films.
Fuji is the todays candidate. But is the Rollei Film Velvia 50/100 ? Is it Provia 100? The answer is : Definitive NO !
So we might say : It is NO new film.
The next question is in concern to Agfa.
Is Agfa (Belgium) able to produce E6 ?
Last year I read an article that the production facilitys (plants) from Agfa Belgium doesn't exist any more.....
...
So the remaining question may be :"If you have stored films (masterols) in freezed condition over some years - and today you find a way to manufacture these masterols with production date years before - via assembling : IS IT THEN A NEW FILM ?"
The answer oft his question is a decision of each of us.

PS : Manufacturers of film speak about
"Production" and we should realize it is "Assemling" in some cases.
That is a little confusion these days.
And it is complete new.Because in the past every new film did need indeed production via emulsion backing.
