That if you have an Internet domain, you have to make sure that you renew the registration before it expires. There are companies out there that keep an eye on the domain registrations, the second it expires they nab it, then hold it for ransom. They then sell to the highest bidder, so if someone else is willing to pay more for it, you may need to take legal action to get anything out of it, and may lose the domain anyway. In the OP's case he was unable to re-register before it expired and lost out.

These days when your domain is often part of your business identity, and you can spend thousands of dollars promoting it, and identifying with it, the fact that someone can legally steal it from you and sell it at a profit means the domain registration system is in some ways, broken.

However we need a system where domains can still be returned to the public. In other words they must expire at some point. The trick is to stay on top of things and renew well in advance of they expiration date, and for multiple years.

I'm not sure of the details of this case, but I don't think the expiration process is broken. Plus most registrars will auto renew your domains if you provide them with your credit card info.

So why should you have the right to sue if it was your mistake? I've been registering domains since the internet went public. You had plenty of time. Something wrong here.

I made no mistake! NameMedia committed an intentional act after I first advised them of my prior common law trademark. The domains expired while I was an incompetent. After six weeks in a coma I was taken off the respirator. I was an incompetent till 2006, I have had years of therapy.


My lawsuit will affect the internet like Roe v. Wade did abortion.
Many will align themselves with the case and many will disagree.

After my lawsuit is resolved, a domain that is used in a real business selling a product or service will never expire. It may stop resolving, but like its common law trademark, it will not expire.
I think it is obvious that they were wrong and will file for a summary judgment as a pauper in a month or so.
