The Message, Brussels 2007

This is another image from a while back that I had not printed (I have posted a scan before).

I was invited about two months ago by the Courtauld School of Fine Art to contribute two of my images to their East Wing N.9 exhibition of Contemporary art. This image happens to be one of them (and also happens to be one of my personal favourites). This is a work print in readiness for printing it up for them when they are ready.

I am often asked this...and the answer is No...this is not set up ;-))

The two seated figures look like some kind of installation. Couldn't be done any better. Brilliant
 
Can I ask if these people know that they are going to appear in an exhibition ? It is a great photograph

Thanks all for the kind words.

TEX; They do not. The image is taken in a public place and is not intended for commercial gain (I am contributing the image free of charge...). Also it is not enough that someone is in the image, it must be demonstrated that their likeness is essential to the content of the image (hence close up portraits etc are sailing close to the wind). In this case the likeness of the individuals is not essential to the image content. Under UK and Belgian law, an image does not require a release if an image is taken in a public place where an individual would not have a reasonable right to expect privacy (this covers most public places). If the image was considered to be demeaning or humiliates a subject even in a public place it would be possible for the individual to contest the use of the image. Note that the law here mainly applies to images in publications.

Without getting on a soap box, I hugely regret that a genre created and mastered by some of the greats is being sapped of all license through expanding laws of Big Brother, and had these existed before, some of the greatest photographs taken would have lingered as an untaken moment or unseen negative. A sad state of affairs.
